Australia: account for state, territory and federal rules
Police may ask an owner for a relevant clip or use legal powers, while a provider may receive separate disclosure process. Surveillance-device laws and privacy coverage vary across states, territories and organisational contexts.
Practical response
- Verify the police agency and event reference.
- Ask whether the request is voluntary or compulsory and identify the legal document.
- Preserve the original and provide only the relevant time and camera where cooperation is voluntary.
- Document the transfer and any follow-up request.
- Check the state or territory law applying to video and audio recording.
Do not rely on the federal Privacy Act as the only rule. State and territory surveillance and police-powers legislation may be central.
Official starting points: OAIC use and disclosure guidance and the USโAustralia CLOUD Act agreement resource for qualifying provider-held evidence.
